Failure to pay a fine from the TCC threatens Ukrainians with money withdrawal and property arrest.


If a conscript fails to receive a summons personally, he has three days to pick it up. Otherwise, he may face a fine in absentia. The decision of the Territorial Centers of Recruitment (TCC) has the legal force of an enforcement document and may result in the forced collection of debt through money withdrawal from the account or seizure of property.
According to the 'Judicial Gazette', the fine amount can range from 17,000 to 25,500 hryvnias. If the fine is not paid voluntarily, enforcement proceedings may commence. The Ministry of Justice has reported that the ruling on the fine will be sent to the local state executive service for forced enforcement. The process may take place at the place of residence, work, or property of the violator in accordance with the law.
Paragraph 1 of Article 48 of the Law provides that enforcement on the debtor's property includes his arrest, seizure of funds from accounts, and enforced execution by the enforcement service. According to paragraph 2 of Article 56 of the Law, the debtor's property may be arrested by the enforcement officer by issuing a decision on the arrest of the debtor's property or on the description and arrest of the debtor's property.
During the forced collection of debt, attention is primarily paid to the debtor's funds, both in national and foreign currency, including money in bank accounts. If the funds are insufficient, the collection may extend to other property. The amount of collection includes not only the debt amount but also additional expenses such as enforcement fee, procedural costs, fines, and remuneration to the enforcement officer.
If the property is jointly owned, the collection applies only to the debtor's share determined by the court. It should be noted that if the debt amount does not exceed 160,000 hryvnias, the debtor's housing and the land plot under it are not subject to collection. In this case, the enforcement officer must seek other ways to collect the debt from the debtor's other property.
