New Car Rental Rules: What They Propose to Change for Drivers.


The Verkhovna Rada of Ukraine will consider a bill that will change the rules for concluding car rental and loan agreements. The Committee on Legal Policy recommended adopting it as a basis.
The main idea of the bill is to cancel the mandatory notarial certification for rental and loan agreements for cars, if they are concluded for a period of less than 3 years. This will simplify the process of concluding short-term agreements.
The authors of the bill explain that in practice, people often do not undergo notarial certification for such agreements, especially if they are short-term. This leads to problems, for example, when compensating for damages in the event of an accident.
The bill also takes into account the practice of the Supreme Court. In particular, case No. 125/1216/20 is mentioned, where the court decided that a vehicle rental agreement involving an individual entrepreneur does not require notarial certification. In another case No. 640/1834/19, the Supreme Court ruled that the absence of notarial certification of a car loan agreement between individuals does not render it invalid.
The deputies note that there are many legal disputes related to the application of the current norms on the rental and loan of vehicles.
